Terms & Conditions
The following terms are delivered through weisishops.com's website and its systems, which are herein referred to as "weisishops".
SALES OF DOMAINS
All domains listed on weisishops are owned exclusively by weisishops.com, its principals, and may be assumed "for sale." When you enter payment through any of weisishops' authorized payment providers you will be making payment for the domain name only and for the exclusive rights to use and enjoy that domain in the future. No images, hosting, logos, or any other rights will be transferred with the domain.
You will be required to register your domain with the registrar of your choosing in order to use and enjoy the domain. You will be required to pay yearly renewal fees to the registrar. Registration fees vary by registrar, and it will be your responsibility as the new owner of the domain to keep its registration current.
RETURNS POLICY
weisishops offers a full refund on domain sales in the event the buyer chooses to return the domain within 30 days of purchase. In order to qualify for a refund, the buyer must have maintained the domain with the current registrar at the time of purchase, and the buyer shall return the domain, including exclusive control thereof, to weisishops. The domain shall not have been used in any negative manner, such as for spam, adult website hosting, or anything that is determined reasonably problematic to the health and value of the domain. A buyer will be permitted one return per calendar year. In the event that weisishops determines that a buyer's actions have caused harm to the health and value of the domain, a refund may not be applied. In all reasonable cases weisishops will honor its Returns Policy. If you purchase a domain and transfer it to another registrar, the domain will be locked for 60 days and will not be eligible for return according to this policy. To be eligible for a return, the domain has to be purchased on weisishops.com and not through a reseller. Payment plan payments are not eligible for our 30 day return policy.
AUCTION POLICY
The buyer acknowledges that bidding in any auction at weisishops is a legally binding contract to purchase the domain, provided that the bid is the winning (highest) bid at the time of expiration of the auction. Further, the buyer authorizes weisishops to charge his or her credit card for the full amount equivalent to the bid price. Domains sold through weisishops auction are considered "As Is" and will not be covered under the Returns Policy.
VERIFICATION OF SALES
Prior to the completion of a sale through weisishops, all domains are subject to a final verification to ensure that that the domain listed is indeed for sale by the current registrant and that there are no previous issues in selling the domain. While all orders are typically approved and transferred immediately upon receipt of payment, a sales receipt does not render the transaction complete. In the event that circumstances arise affecting weisishops's ability to completely deliver a domain to the purchaser, all charges will be appropriately refunded.
Upon successful transfer of a domain to its purchaser will the sale be deemed final.
LEGAL RIGHTS
weisishops is not responsible in determining whether the domain name(s) listed for sale infringe upon the legal rights of others. It is the customer's sole responsibility to research whether the purchase and use of a domain will infringe upon the legal rights of other entities and individuals, including but not limited to trademark infringement.
USE OF YOUR DATA
Please note that the information you submit to weisishops in order to purchase a domain name will be used for the whois information on the domain(s) for which you are purchasing. If you do not wish for your information to be public in whois, please call us prior to making the purchase so we can coordinate the transfer of the domain appropriately.
INDEMNIFICATION
By purchasing a domain from weisishops, you agree that it is your sole responsibility to determine whether the purchase and use of your domain infringes or violates someone else's rights and you agree that weisishops will be held indemnified from any legal actions arising from the purchase and use of domain names from weisishops.
ABUSE OF THE SYSTEM
Should any users be found in abuse of the weisishops website, its programs, processes, or systems, weisishops retains the right to deny service, including access to the weisishops website.
FORCE MAJEURE
The seller shall not be liable for any cessation, interruption, or delay in the performance of its obligations hereunder due to causes beyond its reasonable control.
ASSIGNMENT
You shall not give, bargain, sell, assign, sub-let, or otherwise dispose of this Agreement; or the benefit or advantage of this Agreement; or of any part thereof without express prior consent, in writing, from the Seller.
GOVERNING LAW; JURISDICTION
This Agreement shall be governed by the laws China., without reference to its choice of law rules. The parties agree that the forum for dispute resolution under this Agreement shall be located exclusively in the courts of the City of Denver, State of Colorado, China. The parties specifically exclude the United Nations Convention of Contracts for the International Sale of Goods and the Uniform Computer Information Transactions Act from application to this Agreement.
This document is considered a legally binding contract. The buyer acknowledges these terms and agrees to be bound by them.
